1. Introduction
Welcome to Huefinity!
We're excited to provide you with our professional photography services, Before we get started, please take a moment to review the following terms and conditions. By booking a photoshoot with us, you acknowledge and agree to these terms, ensuring a smooth and professional experience for both parties.
2. Booking and Scheduling
2.1. Booking Process: To book a photoshoot, you must book online through our website or by email. We will discuss the details, including date, time, location, and the specific services you require.
2.2. Scheduling: We will make every effort to accommodate your preferred date and time. However, scheduling is subject to availability.
3. Payment
3.1. Fees: The fees for our services will be discussed during the booking process if not provided prior for exclusive clients. Clients have the option of paying via paypal prior to the shoot, after the shoot, or will be invoiced for direct payment.
3.2. Cancellation: If you need to cancel a booking, we require at least 24 hours' notice before the scheduled shoot to avoid any cancellation fees.
4. Property Preparation
4.1. Property Readiness: It is your responsibility to ensure the property is full prepared for the photoshoot, including cleaning, decluttering, and staging as needed, Our photographers will not handle any tenant belongings or move furniture, To ensure the best results, we recommend that you or a representative be present on-site during the shoot.
4.2. On-Site Attendance: By proceeding with this booking, you confirm that you have provided all necessary and accurate details, including but not limited to preferred photograph angles, drone location requirements, property address, and access instructions, if not, you agree to be present on-site to provide guidance as needed.
4.3. On-Site Cancellation: If a booking is canceled on-site and the photoshoot cannot proceed, the full shoot fee will still apply
5. Licensing and Usage
5.1. Usage Rights: Upon full payment, you are granted a license to use any/all content to use for marketing and promotional purposes relate to property. However, Huefinity Media retains full ownership and intellectual property right to all digital content created.
5.2. Third-Party Usage: All digital content created by Huefinity Media may not be sold, licensed or transferred to any third party without our written permission
6. Delivery
6.1. Turnaround Time: We guarantee the deliver of all photographs within 24 hours (next business day) from the time of the shoot.
6.2. Digital Delivery: Photographs will be delivered in digital format via dropbox/google drive.
7. Copyright and Reproduction
7.1. Copyright: You are not permitted to modify, edit, or alter any content in any manner without our prior consent.
7.2. Photographer’s Right: We retain all rights to the digital content we create.
8. Quality Assurance
8.1. Revisions: If you feel the photographs/video-graphs, and other services we provide do not meet the agreed-upon standards, you must notify us within 48 hours of delivery. We will promptly review and resolve any valid concerns to ensure your satisfaction.
9. Liability
9.1. Property Damages: We will excersie all reasonable care to prevent any damage to the property during the photoshoot. However, we cannot be held liable for any unforeseen damages that may occur.
9.2. Limitation of Liability: Our liability is limited to the total fees paid for our services. We wont be held responsible for any indirect, incidental or consequential damages.
10. Dispute Resolution
10.1. Mediation: In the event of a dispute, both parties agree to engage in mediation as a first course of action prior considering legal proceedings.
11. Termination
11.1. Termination: We reserve the right to terminate any/all services if, at any time, we believe that the client is not adhering to these terms, including instances of unprofessional behaviour.
12. Governing Law
12.1. Jurisdiction: These terms are subject to the laws of New South Wales
13. Updates
13.1. Amendments: We may update these terms & conditions without notice. You will be subject to the latest version of these terms.
14. Service Area and Travel Fees
14.1. Service Area: Our service area is 50km from the CBD of Sydney
14.2. Travel Fee: Addresses exceeding 50km from the CBD of Sydney will be subject to incur a $50 travel fee.
By accepting these Terms of Service, you confirm that all information provided for your booking is complete and accurate.
